Municipal Court questions:
What can I expect on my court date?
Your first appearance is what is known as an arraignment. Please arrive on time as the Judge makes some VERY important announcements as to your rights. Also, please dress appropriately for court (no tank/halter tops, muscle shirts, shorts, ragged clothing, etc.; see the dress code here).
Court begins by the Judge making some preliminary announcements as to processes, procedures, options and your rights. The Judge will then call the docket (list of cases) and ask each person how they wish to plea. After calling the docket, the Judge will begin taking any pleas that have been negotiated. This process will continue until each case has been disposed of.
How do I pay my fine?
After allowing 7-10 business days from the issue date on citation, you may call the Traffic Violations Bureau (678-512-3444). You may dispose of certain violations before your assigned court date by accessing the online payments website. If your citation is payable, you may either pay it on-line or by mail.
Payments are accepted in person from 8:30 am to 4:30 pm at the Municipal Court, 11445 Johns Creek Parkway, Johns Creek, GA 30097.
If you have multiple citations you must dispose of all citations at the same time. If one or more violations is a "must appear" (requires a court appearance to resolve), you may not pay online.
Understand that paying by mail or on-line may result in points being assessed to your drivers history.
What forms of payment are used?
Cash (do not mail), Money Order, Certified Check, Visa or MasterCard in person or on-line only.
How do I re-set my case?
In order to have your case re-set, you must appear in Court and speak to either the Judge or Solicitor, NO EXCEPTIONS.
Can I negotiate a plea?
Yes. You may accomplish this by speaking to the Solicitor/Prosecutor. This may only be done on your assigned court date. The Solicitor will be in the Court room approximately 30 minutes before court begins and does not leave until everyone has had the opportunity to speak to him/her.
What are my plea options?
The information listed below is NOT legal advice as you have many rights available to you.
Plea of Guilty: An admission of Guilt. Depending on the offense, this plea may apply points to your drivers history or have other adverse affects.
Plea of Not Guilty: By pleading not guilty, you may request a bench trial or if applicable, you may request your case be bound over to Fulton County for a jury trial.
Plea of Nolo Contendere (Often known as Nolo or No Contest): This plea is only available once every five (5) years and is discretionary. This plea requires your appearance in court.
