I would like the good citizens of the City of Johns Creek to know that everything legally possible is being done to address this issue. I ask for your understanding and patience as we follow the legal transition from Fulton County to City of Johns Creek authority.
We are currently in that transition process and so Fulton County still holds jurisdiction over this matter. Though we’re currently constrained by transition components of our charter, we’ll move quickly to ensure legal compliance with all components of the law.
Our city stands ready to participate and defend our community’s standards as soon as we’re legally allowed.
I want you to know, however, that we anticipated this action on the part of the Love Shack.
Today, a Fulton County Superior Court Judge dismissed a Fulton County Attorney’s Office’s request for a temporary restraining order against the Love Shack, saying that the case belonged in US District Court because there’s already an outstanding lawsuit there between the Love Shack and Fulton County.
Fulton County also filed today a contempt citation against the Love Shack, requesting US District Court Judge Thomas W. Thrash to act on this contempt citation.
What all this means is that Fulton County is asking the courts to close the Love Shack.
While we can’t predict the outcome of a pending legal action, we agree strongly with the position Fulton County is taking on behalf of you, our citizens, and we’re confident the courts will do the right thing.
